1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of ProofThis ("ProofThis," "we," "our," or "us")—our website, platform, and related services. By creating an account, submitting ideas, voting, or otherwise using ProofThis, you agree to these Terms and to our Privacy Policy. If you do not agree, you may not use our services.

2. Description of Service

ProofThis is a community-driven validation platform where solopreneurs and indie hackers can submit SaaS ideas, gather votes from potential users, and validate market demand before building. Users can upvote or downvote ideas, signal "I'd pay for this" (creating a waitlist for creators), comment, and browse a leaderboard. We offer free and premium (paid) tiers. We reserve the right to modify, suspend, or discontinue any part of the service with notice where appropriate.

3. Eligibility

You must be at least 16 years old and able to form a binding contract to use ProofThis. If you use the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. You must comply with all applicable laws in your use of the platform.

4. Account and Verification

You create and manage your account through our authentication provider (Clerk). To submit ideas, you must verify your account via GitHub (required). Optional LinkedIn verification may grant you a "Verified Professional" badge. You are responsible for keeping your credentials secure and for all activity under your account. You must provide accurate information and update it as needed.

5. Content Policy and Acceptable Use

ProofThis is for pre-build validation of software and digital product ideas. You agree to use the service only for lawful purposes and in line with our content policy.

Allowed content:

  • SaaS product ideas
  • Digital service ideas
  • Chrome extensions, mobile apps, or similar if they follow a SaaS or digital-service model

Not allowed:

  • Physical products (this platform is for digital/SaaS validation)
  • Crypto, blockchain, or highly speculative investment projects
  • Adult content
  • Gambling or illegal services
  • Pyramid schemes or multi-level marketing (MLM)
  • Content that infringes others' intellectual property, promotes harm, or violates these Terms or applicable law

We may remove content, suspend accounts, or take other action if we determine that content or conduct violates these rules or is harmful to the community. Users can flag ideas (e.g., spam, inappropriate, duplicate); ideas that receive a significant number of flags may be reviewed by us.

6. Submitting Ideas

When you submit an idea, you must provide accurate information and comply with our submission requirements (e.g., minimum character lengths for problem and solution, category selection). Submission limits apply: free users may submit one idea per week; premium users may have higher or unlimited limits as described on the pricing page. We use automated and manual moderation to detect duplicates, spam, and policy violations. We may reject or remove ideas that do not meet our quality or policy standards.

7. Voting and "I'd Pay for This"

Voting is intended to reflect genuine interest in ideas. You may not use fake accounts, bots, or other means to manipulate votes. We use rate limiting and other measures to prevent abuse. When you use "I'd pay for this," you may be asked to provide an email for launch notifications; that email may be shared with the idea creator as described in our Privacy Policy. Your participation in commitments is voluntary.

8. Premium Subscriptions and Payments

Premium features (e.g., advanced analytics, waitlist export, featured placement) are subject to the pricing and billing terms displayed at sign-up. Payments are processed by Stripe. You authorize us to charge your payment method on a recurring basis until you cancel. Fees are generally non-refundable; we may make exceptions at our discretion or where required by law. You may cancel your subscription through your account or Stripe; cancellation will take effect at the end of the current billing period. If you request account deletion, your subscription will be cancelled and you will not be charged again; no refund will be provided for any unused portion of the current period.

9. Your Content and License to Us

You retain ownership of the content you submit (ideas, comments, profile information). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, host, store, display, and distribute that content in connection with operating and promoting ProofThis. You represent that you have the right to grant this license and that your content does not infringe any third party's rights.

10. Our Intellectual Property

ProofThis and its branding, design, and technology are owned by us or our licensors. You may not copy, modify, or create derivative works of our service or use our trademarks without our prior written permission.

11. Termination

You may stop using ProofThis and close your account at any time. We may suspend or terminate your access if you breach these Terms, for operational or legal reasons, or at our discretion. Upon termination, your right to use the service ceases. Provisions that by their nature should survive (e.g., indemnity, limitations of liability, dispute resolution) will survive.

12. Disclaimers

ProofThis is provided "as is" and "as available." We do not guarantee that the platform will be uninterrupted, error-free, or free of harmful components. Votes and "I'd pay" commitments are signals of interest, not guarantees of commercial success. We are not responsible for the success or failure of any idea or product, or for the conduct of users or third parties.

13. Limitation of Liability

To the maximum extent permitted by law, ProofThis and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the service. Our total liability for any claims arising from or related to these Terms or the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred U.S. dollars (USD $100), whichever is greater. Some jurisdictions do not allow certain limitations; in such cases, our liability will be limited to the fullest extent permitted by law.

14. Indemnification

You agree to indemnify and hold harmless ProofThis and its affiliates, officers, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service, your content, or your breach of these Terms.

15. Disputes and Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or the service will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. You may also have rights under consumer protection laws in your jurisdiction.

16. Changes to the Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. For material changes, we may notify you by email or through the platform. Your continued use of ProofThis after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the service.
